Agreement governing the use of guppie.au services

By accessing or using guppie.au, you agree to be bound by these Terms of Service. Please read them carefully before making a purchase or using our services.

1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and guppie.au (trading as guppie.au) regarding your use of our website and purchase of live fish.

By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you do not agree to these terms, you must not use our services.

2. Products & Services

2.1 Product Description

We breed and sell live guppies (Poecilia reticulata). Product descriptions, images, and videos are provided for informational purposes. Due to the natural variation in live animals, individual fish may differ slightly from images shown.

2.2 Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion. Pricing is subject to change without notice.

2.3 Product Accuracy

We make every effort to ensure product information is accurate. However, we do not warrant that descriptions, images, or other content are completely accurate, current, or error-free.

3. Orders & Payment

3.1 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order. Order confirmation does not constitute acceptance. Acceptance occurs when fish are dispatched and you receive shipping confirmation.

3.2 Pricing

All prices are in Australian Dollars (AUD) and include GST where applicable. Shipping costs are additional and calculated at checkout. We reserve the right to correct pricing errors.

3.3 Payment

Payment is required before dispatch. We accept payment methods as indicated at checkout. You warrant that you are authorised to use the payment method provided.

Note: Payment processing may be handled by third-party providers subject to their own terms and conditions.

4. Shipping & Delivery

4.1 Shipping Area

We ship within Australia only, excluding Western Australia, Northern Territory, and Tasmania due to biosecurity restrictions.

Important: Orders to WA, NT, or TAS will be refused. You are responsible for ensuring compliance with your state's biosecurity regulations.

4.2 Weather-Dependent Shipping

Live fish shipping is weather-dependent. We monitor forecasts and will delay shipment if conditions are unsuitable (extreme heat, cold, or severe weather). We will notify you of any delays.

4.3 Shipping Method

Fish are typically shipped via Australia Post Express Post or approved courier. Transit time is usually 1-2 business days, but may vary. We are not responsible for carrier delays beyond our control.

4.4 Delivery Requirements

You must provide an accurate delivery address where someone will be available to receive the package. You are responsible for:

  • Being available to receive live fish promptly
  • Monitoring tracking information provided
  • Acclimating fish according to provided instructions

4.5 Risk of Loss

Risk of loss and title for fish pass to you upon delivery to the carrier. We are not liable for delays or damage occurring during transit, except as covered by our Live Arrival Guarantee (Section 5).

5. Live Arrival Guarantee

5.1 Guarantee Coverage

We guarantee live arrival of fish when shipped under appropriate conditions. If fish arrive deceased, we will provide replacement or refund, subject to the conditions below.

5.2 Claim Requirements

To make a claim under this guarantee, you must:

  • Contact us within 2 hours of delivery
  • Provide clear photographs of deceased fish in original packaging
  • Provide proof of timely package receipt
  • Not have opened bags or acclimated fish

5.3 Guarantee Exclusions

This guarantee does not cover:

  • Death occurring after acclimation or tank introduction
  • Delayed package receipt beyond 2 hours of delivery
  • Incorrect delivery address provided by customer
  • Refusal to accept delivery or unavailability to receive package
  • Failure to follow provided acclimation instructions

5.4 Remedy Limitation

Our sole obligation under this guarantee is to replace deceased fish or refund the purchase price (excluding shipping). We are not liable for consequential damages, including but not limited to loss of other livestock.

6. Returns & Refunds

6.1 No Returns Policy

Due to the nature of live animals and biosecurity concerns, we cannot accept returns of live fish once shipped. All sales are final except as provided under our Live Arrival Guarantee (Section 5) or Australian Consumer Law.

6.2 Refunds

Refunds will be issued only in cases where fish arrive deceased and all guarantee conditions are met, or where we cancel an order. Refunds will be processed to the original payment method within 7-14 business days.

6.3 Order Cancellation

You may cancel your order before shipping for a full refund. Once fish are dispatched, cancellation is not possible. We reserve the right to cancel orders if fish are unavailable, payment fails, or for other legitimate reasons.

7. Customer Responsibilities

By purchasing live fish, you represent and warrant that:

  • You have appropriate aquarium equipment and knowledge to care for guppies
  • You comply with all applicable local, state, and federal laws regarding keeping aquarium fish
  • You will not release fish into natural waterways or outdoor environments
  • You understand that guppies are live animals requiring proper ongoing care
  • You will follow provided acclimation and care instructions

8. Limitation of Liability

8.1 Maximum Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your purchase shall not exceed the amount you paid for the specific fish in question.

8.2 Exclusion of Consequential Damages

We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, loss of other livestock, aquarium damage, or emotional distress, arising from your purchase or use of our products.

8.3 Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any guarantee, warranty, term, condition, or remedy implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.

9. Intellectual Property

All content on guppie.au, including text, images, videos, logos, and design elements, is owned by or licensed to guppie.au and protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from our content without express written permission. Unauthorised use may violate copyright, trademark, and other laws.

10. Acceptable Website Use

You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorised access to our systems
  • Transmit viruses, malware, or harmful code
  • Scrape, data mine, or harvest information from our website
  • Impersonate any person or misrepresent your affiliation
  • Interfere with or disrupt website functionality

Australian Consumer Law: Nothing in this section affects your rights under the Australian Consumer Law, including your right to seek resolution through consumer protection agencies or tribunals.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. We will update the "Effective Date" at the top of this page.

Your continued use of our website after changes are posted constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

Material changes affecting existing orders will not apply retroactively to those orders unless required by law.

15. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement
